Flagbearer of the the National Democratic Congress (NDC) , John Dramani Mahama on Tuesday December 30, 2020 filed a petition at the Supreme Court to challenge the results of the 2020 presidential elections.
Specifically, Mr. Mahama is praying the apex court to annul the 2020 presidential results as well as order the Electoral Commission Chairperson (EC), Jean Adukwei Mensa to conduct a fresh election for the presidential candidates as required under Articles 63(4) and (5) of the 1992 Constitution.
The former president’s petition has Chairperson of the EC as the 1st Respondent and President Nana Addo Dankwa Akufo-Addo as the 2nd Respondent respectively.
NPP candidate Nana Akufo-Addo defeated his rival with 51.59 percent of valid votes cast as against John Mahama of the NDC who polled 47.36 percent.
In total Akufo-Addo garnered 6,730,413 votes whilst John Mahama secure 6,214,889 of the total votes cast.
The NDC claims there were computational errors and that none of the candidates obtained the mandatory 50 percent plus 1 vote to win the election.
Mr. Mahama has however rejected the results as declared by the EC on 9th December, 2020 on the following grounds:
That (1) ‘the said declaration was made arbitrarily, capriciously, and with bias in favour of 2nd Respondent, contrary to Article 296(b) of the 1992 Constitution’.
That (2) ‘the said declaration was made without regard to due process of law as required under Articles 23 and 296 (b) of the 1992 Constitution’
That (3) ‘in making the said declaration, Mrs Jean Adukwei Mensa, Chairperson of 1st Respondent and the Returning Officer for the Presidential Elections, violated the constitutional duty imposed on her by Articles 23 and 296(a) of the Constitution to be fair, candid and reasonable’.
